Welcome to Breakout Story ("we," "our," or "us"). Please read these Terms of Service ("Terms") carefully as they contain important information regarding your legal rights, remedies, and obligations.

1. ACCEPTANCE OF TERMS

By accessing or using the Breakout Story website (the "Site") and any services offered through the Site, including but not limited to coaching services, courses, and tutorials (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site or Services.

2. DESCRIPTION OF SERVICES

Breakout Story provides screenwriting coaching services, educational content, and other related services as described on the Site. These Services include, but are not limited to:

  • Free tutorials and educational content
  • Paid online courses
  • Individual coaching sessions
  • Group coaching sessions
  • Pre-writing development services

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time.

3. USER ACCOUNTS

To access certain Services, you may be required to create an account. When registering for an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. FEES AND PAYMENT

4.1 Pricing

We reserve the right to change prices of our services, products and content at any time, but changes will not affect orders already accepted unless we have notified you before processing your payment.

4.2 Payment Processing

Payments are processed through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms of service and privacy policy. We do not store your full payment information on our servers.

4.3 Recurring Payments

For subscription-based services, such as ongoing coaching packages, you authorize us to charge your payment method on a recurring basis until you cancel your subscription or we terminate it.

5. REFUND POLICY

5.1 Courses

For the Pre-Writing Workshop course, you may request a refund via email within 24 hours of purchase if you are not satisfied. After this period, no refunds will be issued.

5.2 Coaching Services

For individual and group coaching programs, full refunds will be issued if requested before the first session has been completed. After the first session has been completed, refunds will not be available. 

6. SCHEDULING AND ATTENDANCE

6.1 Session Scheduling

All coaching sessions must be scheduled in advance through our online booking system or via direct communication with Conrad Sun.

6.2 Late Attendance

If you arrive late to a scheduled session, the session will still end at the originally scheduled time, and no make-up time will be provided.

6.3 Missed Sessions

If you miss a scheduled session without providing at least 24 hours' notice, the session will be forfeited without refund.

7. INTELLECTUAL PROPERTY

7.1 Our Content

All content on the Site and within our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of Breakout Story or its content suppliers and is protected by United States and international copyright laws.

7.2 Your Content

By sharing your screenplays, concepts, or other creative works with us through our Services, you retain all of your intellectual property rights. However, you grant us a non-exclusive, royalty-free license to use, reproduce, and store your content solely for the purpose of providing our Services to you.

7.3 No Representation or Management

Participation in our coaching programs or courses does not constitute representation by Conrad Sun as a literary manager. Our Services are strictly educational and developmental in nature.

8. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, SECURITY, OR ACCURACY OF THE SERVICES. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9. LIMITATION OF LIABILITY

IN NO EVENT SHALL BREAKOUT STORY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Breakout Story and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another.

11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.

12. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of these Terms. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.
